By accessing our website, requesting an audit, or subscribing to our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
1. Description of Services
MaxProtect provides managed security services for Linux servers (On-Premise, OCI, AWS, Azure, GCP, DigitalOcean, Alibaba Cloud, etc.). Our Services include, but are not limited to:
- Free External Security Assessments: Non-intrusive external audits of server public footprints.
- Endpoint Protection (EPP) & SOC Monitoring: 24/7 human-led Security Operations Center monitoring, behavioral threat prevention, and endpoint protection.
- Managed Hardening & Patching: OS configuration, service-level hardening, and targeted updates for kernel and core services.
- Vulnerability Reporting: Monthly technical resilience and vulnerability reports.
2. Eligibility & Audit Scope
By requesting a Free External Assessment or subscribing to our Services, you represent and warrant that you are the owner or authorized administrator of the targeted infrastructure.
- Audit Eligibility: Our free audits and standard deployments are designed specifically for Dedicated Servers, VPS, and Cloud Instances.
- Shared Hosting: We cannot perform audits or deploy our Services on standard “Shared Hosting” accounts unless you are the owner/administrator of the entire physical or virtual server.
- External Assessment: Our free audits are performed externally. We do not require, nor will we ask for, server-level credentials, SSH access, or internal login details to generate your initial Security Health Snapshot.
3. Subscription, Pricing, and Billing
We offer transparent pricing tiers based on your infrastructure requirements:
- Tier 1 (Free): External Security Assessment and Linux Hardening Checklist.
- Tier 2 ($100 /server /month): Includes 24/7 SOC Monitoring, Endpoint Protection Agent, Managed Patching, Monthly Reports, and Unlimited Security Incident Support.
- Tier 3 (Custom): Enterprise-grade white-label SOC and tailored threat playbooks.
Payment Terms:
- Fees for premium subscriptions are billed monthly on a per-server basis unless otherwise negotiated in a custom contract.
- All payments are non-refundable unless legally required or explicitly stated in a specific Service Level Agreement (SLA).
- MaxProtect reserves the right to suspend Services if payments are not received by the due date.
4. Client Obligations
To ensure the effectiveness of MaxProtect’s services, you agree to:
- Provide accurate and complete information regarding your infrastructure and contact details.
- Allow our Endpoint Protection Agent to communicate with our SOC uninterrupted.
- Review our monthly vulnerability scans and cooperate with our team regarding necessary reboots, legacy service deprecations, or manual patching operations where client input is required.
- Not use our Services to engage in any unlawful activities or to obscure malicious activities originating from your servers.
5. Security Limitations & Disclaimer of Warranties
While MaxProtect employs advanced, human-led SOC monitoring and proactive endpoint protection to secure your Linux environment, no cybersecurity solution is 100% impenetrable. * No Guarantee Against Breaches: MaxProtect does not guarantee that your servers will be immune to all hacks, data breaches, zero-day exploits, or ransomware attacks.
- “As Is” Service: The Services are provided on an “as is” and “as available” basis. MaxProtect and its parent company, MaxAPEX, expressly disclaim any warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
6. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall MaxProtect, MaxAPEX, or its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:
- Loss of profits, data, use, or goodwill.
- Server downtime or business interruptions.
- Data loss resulting from cyberattacks, ransomware, or malicious third-party activities.
- System instability caused by managed patching or legacy service deprecation.
In no event shall our total liability to you for any claims arising out of or relating to the Services exceed the total amount paid by you to MaxProtect in the three (3) months preceding the event giving rise to the liability.
7. Data Privacy and Confidentiality
Your privacy is important to us. Any data collected during external assessments, SOC monitoring, and client communication is handled in accordance with our Privacy Policy. We strictly maintain the confidentiality of your infrastructure vulnerabilities and will never disclose your specific security flaws to third parties without your explicit consent, except as required by law.
8. Term and Termination
- By You: You may cancel your MaxProtect monthly subscription at any time by contacting our support team. Cancellation will take effect at the end of the current billing cycle.
- By Us: We reserve the right to suspend or terminate your access to the Services immediately, without prior notice or liability, if you breach these Terms, fail to pay subscription fees, or use our Services for abusive/illegal purposes.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising out of these Terms shall be resolved in the state or federal courts located in Texas.
10. Changes to These Terms
MaxProtect reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. By continuing to access or use our Services after revisions become effective, you agree to be bound by the updated Terms.
